PRIVACY NOTICE - Updated May 12, 2021

Adably Labs, Inc. (“Adably Labs”, “we”, “us”, or “our”) operates www.adablylabs.com (“Website”) and browser extensions such as the Adably Labs chrome extension (the “Extension”, together with Website and the services provided thereon, the “Services”). This Privacy Notice explains how Adably Labs collects, uses, stores, and shares personal information that we collect when you access our Website or use our Services.


1. ADVERTISING

Our Extension does not display nor inject advertising into our users' web pages, nor does Adably Labs operate any referral program nor modify any page content due to referrals or sponsors. However, we do have our own advertising partners that help us with advertising the Services. See Sections 2, 4, and 5 below for more information about our own advertising.


2. COLLECTION AND USE OF PERSONAL INFORMATION

Information collected from you:

Adably Labs collects the following information from consumers who access our Website, download our Extension or use our Services:

  • Identifier—such as your email address, an IP address, or the unique identifier we generate and assign to you that is unique to your browser or mobile device.
  • Web History & Website Content—we collect information about your online browsing, such as the websites you visit, which advertisements are shown to you, browser type, language preference, referring site, and date and time of each visitor request.

Market research and analysis: We collect your email address from you if you provide it. We collect your identifiers and browsing history automatically when you visit our website or use our Services. We use your identifiers, browsing history and geolocation information to understand trends and usage in internet browsing and advertising. We analyze the information collected and provide insights derived from it to our customers.

Email marketing: If you are a registered user of our Website and have supplied your email address, we may occasionally send you an email to tell you about new features, solicit your feedback, or keep you up to date with our products.

Support and response to requests: If you send us a request, such as via hello@adably.com or via one of our feedback mechanisms, such as through the Apple App Store, we collect your identifiers and any other personal information you choose to include in such communication. We may publish your feedback without any identifying information in order to help us clarify or respond to your request or to help us support other users.

Information collected from third parties:

Adably Labs collects the following information from third parties when consumers use our Services:

  • Geolocation Information—we collect your zip code.

Disclosure of your personal information: We share your IP address with our service provider who processes that information to provide us with your zip code. Outside of the sharing of your IP address with our service provider as explained above, and except as outlined in Section 4 below, we do not disclose or sell your personal information to third parties unless it is in aggregated form. We may share this aggregated information such as by publishing a report on trends in advertising, how much we estimate certain advertisers are spending, and for other market research, data modeling, and analytics uses. We do not use or transfer user data for purposes that are unrelated to our Extension. We do not use or transfer user data to determine creditworthiness or for lending purposes. The use of information received from Google APIs will adhere to the Chrome Web Store User Data Policy, including the Limited Use requirements.


3. COOKIES AND OTHER SIMILAR TECHNOLOGIES

We use cookies through our Extension. A cookie is a string of information that a website stores on a visitor's computer, and that the visitor's browser provides to the website each time the visitor returns. Cookies usually also have an expiration date. For example, some cookies are automatically deleted when you close your browser (these are “session cookies”), while others stay longer on your computer, sometimes even until you delete them manually (these are “persistent cookies”).

We use first-party cookies, which are cookies that we place on your computer or device, and third-party cookies, which are cookies that we allow third parties to place on your computer or device.

Required

These cookies are required for making use of the Services.

Functional

These cookies record some of your activity on the Extension as well as information about your device, such as what browser you are running, and what pages you access. This information helps us and our third party service providers diagnose server and software errors, and in cases of abuse, track and mitigate the abuse.

Analytics

Our service providers, including Google, use cookies as part of their tools. These cookies allow our service providers and us to recognize and count the number of users of the Services, to see how users move around the Website, and how they engage with different functions, including usage statistics, when they are using the Services.

Advertising

Our advertising providers use web pixels to identify and store behaviors that users take when visiting our Website or using our Services (such as pages visited). These pixels are used in order to: (i) identify you as a prospect for our services; (ii) deliver advertisements that are more relevant to you and your interests; (iii) limit the number of times you see an advertisement as well as (iv) help measure the effectiveness of the advertising campaign. If a user engages with our content, their behavior on our Website is used to present them with targeted advertising based on their interests. This means that after you are done browsing our website you may see some advertisements about our Services or products elsewhere on the Internet.

You can control the use of cookies and pixels on your computer or device using any of the methods identified in the YOUR CHOICES WITH RESPECT TO YOUR INFORMATION below. However, if you set your browser or device to refuse cookies, certain features of our Extension may not function properly.


4. PROTECTION AND DISCLOSURE OF YOUR PERSONAL INFORMATION

Adably Labs takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of personal information.

Adably Labs may disclose your personal information in the following circumstances:

Corporate Family and Service Providers. Adably Labs discloses information, including personal information, to those of its employees, contractors and affiliated organizations that need to know that information in order to process it on Adably Labs's behalf or to provide services available at Adably Labs's websites.

Corporate Reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction and such information would be part of the assets sold. We would share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

Legal Purposes. Adably Labs will share personal information where we are legally required to do so, such as in response to court orders, law enforcement, or legal process; to establish, protect, or exercise our legal rights; to defend against legal claims or demands; or to comply with the requirements of any applicable law.

To Prevent Harm. Adably Labs will share information if we believe it necessary to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.

With Your Consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time by writing us at hello@adably.com.

In the past 12 months, we have disclosed your identifiers and geolocation information with our service providers.


5. YOUR CHOICES WITH RESPECT TO YOUR INFORMATION

Behavioral or Interest-Based Advertising Generally: Some mobile devices provide options to opt out of behavioral advertising, such as the “Limit Ad Tracking” setting on iOS devices or setting to “Opt out of Interest-Based Ads” on Android devices. You can opt out of certain behavioral advertisements by clicking on the “Ad Choices” icon or visiting https://optout.aboutads.info. To learn more about the use of your information for behavioral advertising, visit the Network Advertising Initiative, (https://optout.networkadvertising.org/) or the Digital Advertising Alliance (https://youradchoices.com/control).

Please note that these actions will not opt you out of being served advertising. You will continue to receive generic ads.

Google Analytics: See https://policies.google.com/technologies/partner-sites for information about how Google uses the information provided to Google Analytics. You can control the information provided to Google and opt out of certain ads provided by Google by using any of the methods set forth here or using the Google Analytics opt out browser add-on here.

All cookies:

A session cookie is temporary and disappears after you close your browser. Persistent cookies can be removed by following your web browser’s directions.

If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of the website may not function properly.


6. PRIVACY RIGHTS

The California Consumer Privacy Act of 2018 (“CCPA”) and other legislation, grant certain rights to our users to access or delete the personal information that we have collected about them, to opt-out of the sale of their personal information by us to a third party and not to be discriminated against for exercising these rights.

Access

You have the right to request what personal information we collected, used, disclosed, and sold about you within the preceding 12 months.

Once we receive your request and confirm your identity, we will disclose to you information we have collected about you as required by the CCPA.

Deletion

Subject to certain exceptions, you have the right to request the deletion of your personal information that we collect or maintain.

Once we receive your request and confirm your identity, we will de-identify (and direct our service providers to de-identify) your personal information from our records, unless an exception applies under the CCPA.

Opt-Out

We do not sell any of your personal information.

We have third party cookies on our website that get access to your personal information in order to assist us with analyzing your activity on our Website and Extension and to provide advertising to you. Non-Discrimination

You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, or opt-out under the CCPA.

This means we cannot, for example, deny goods or services to you or charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties, due to you having exercised your rights.

Exercising Your Rights

In order to exercise your right to delete the information, you can send an email to RightToForget@adably.com. Please include “Deletion Request” in the subject line of your email.

In order to exercise your right to access the information, you can send an email to RightToKnow@adably.com. Please include “Deletion Request” in the subject line of your email.

For your access request, please note that, in certain cases, we collect very limited information about you and do not keep sufficient information necessary to verify your identity. In such cases, we would only be able to provide information to you about the categories of personal information we collect.

You may also, at any time, uninstall the Extension, thereby preventing any further collection of your personal information through the Extension.

We aim to respond to your request for access or deletion within 45 days of receiving the request. If we need more time to respond to your request, we will let you know the reason and how much additional time we will need.


7. DO NOT TRACK DISCLOSURE

We do not support Do Not Track ("DNT"). DNT is a preference you can set on your web browser to inform websites that you do not want to be tracked.

8. CHILDREN’S PRIVACY

The Services are not marketed to and we do not knowingly collect or maintain personal information from children under the age of 16. If we learn that we have collected or received personal information from a child under the age of 16 without verification of parental consent, we will delete that information. If you believe we have any information about a child under the age of 16, please let us know.

This Privacy Notice may be updated and changed from time to time. We will post the new Notice on this page and will indicate the date it goes into effect. Each version of this Privacy Notice will be identified by its effective date, which you can find at the bottom of the page.
